MEMORANDUM DECISION

{¶ 1} On April 3, 2009, at approximately 10:30 a.m., plaintiff, Fred Christie, was traveling on Interstate 77 through a construction zone, when his 2007 Toyota Avalon struck a pothole near the Pleasant Valley Road Exit causing tire damage to the vehicle.
