{¶ 1} This matter is before the Court on the Notice of Appeal of Brian J. Jenkins, filed November 14, 2008. On August 5, 2008, Jenkins was indicted on one count of robbery (physical harm), in violation of R.C. 2911.02(A)(2), a felony of the second degree. On August 19, 2008, Jenkins pled not guilty.
