FINDINGS OF FACT

{¶ 1} "1) On February 9, 2009, at approximately 4:00 p.m., plaintiff, William E. Wyatt, was traveling south on Interstate 75 through a construction zone "near mile marker 28" when his 2004 Chevrolet Aveo struck a "very large pothole" causing tire damage to the vehicle.
