{¶ 1} Appellant, Rizharr D. Holmes, was indicted for one count of aggravated burglary and two counts of rape, each felonies of the first degree. A jury convicted him of aggravated burglary and one count of rape. On the second count of rape, the jury convicted him of the lesser included offense of attempted rape, a felony of the second degree. Holmes was sentenced to eight years incarceration...
