{¶ 1} 1) On February 1, 2009, at approximately 7:30 p.m., plaintiff, Edward Moneypenny, was traveling on Interstate 271 in Summit county through a construction area, when his 2009 Chevrolet Silverado 1500 pick-up truck struck a large pothole causing rim damage to the vehicle.
