FINDINGS OF FACT

{¶ 1} 1) On December 28, 2008, at approximately 7:30 p.m., plaintiff, Charles A. Spurr, was traveling south on Lockwood Boulevard in Boardman, Ohio, about one half-mile from State Route 224, when his automobile struck a large pothole causing substantial damage to the vehicle.
