{¶1} On July 7, 2006, the Muskingum County Grand Jury indicted appellant, Charles Mitchell, on count of aggravated burglary in violation of R.C. 2911.12(A)(2), one count of kidnapping with a sexual motivation specification and a sexually violent predator specification in violation of R.C. 2905.01(A)(4), and four counts of rape in violation of R.C. 2907.02(A)(2).
