{¶1} On October 28, 2005, the Delaware County Grand Jury indicted appellant, Christopher Nagel, on two counts of aggravated vehicular assault in violation of R.C. 2903.08(A)(1)(a), second degree felonies, and two counts of vehicular assault in violation of R.C. 2903.08(A)(2)(b), third degree felonies.
