{¶ 1} This matter is before the court on relator Ralph D. Hayward's petition for a writ of mandamus. Relator seeks an order from this court directing respondent, the Honorable Craig L. Roth, to approve relator's statement of the evidence pursuant to App.R. 9(C). Respondent has filed a motion for summary judgment asserting that relator has an adequate remedy at law.
