DECISION AND JUDGMENT

WILLAMOWSKI, J.

{¶ 1} Appellant, Samuel Mallette, Jr., appeals a grant of summary judgment rendered by the Lucas County Court of Common Pleas in a personal injury case. For the reasons herein, we reverse.
