{¶ 1} This matter is before the Court on the Notice of Appeal of Justin E. Henson, filed July 1, 2008. On August 16, 2007, Henson was indicted on one count of felonious assault of a peace officer, in violation of R.C. 2903.11(A)(1), a felony of the first degree, and one count of attempted murder, in violation of R.C. 2923.02(A) and 2903.02(B), also a felony of the first degree.
