{¶ 1} This is an appeal as of right brought by the state of Ohio pursuant to R.C. 2945.67 from an order of the Lucas County Court of Common Pleas granting appellee's motion to dismiss all or part of the indictment brought against him. For the following reasons, the judgment of the trial court is reversed.
