{¶ 1} This matter is before the Court on the Notice of Appeal of Darrell Richardson, filed August 28, 2007, and the State's Motion to Dismiss, filed May 16, 2008. On March 27, 2007, a detective from the Bellbrook Police Department issued Richardson a misdemeanor citation for assault, in violation of R.C. 2903.13(A).
