{¶1} Appellant, State of Ohio, appeals from the judgment entry of the Ashtabula County Court of Common Pleas, granting Appellee, Gene Snowden's Motion for a New Trial. Due to the court's conclusion that there was insufficient evidence to sustain the jury's verdict, we need not reach the merits of the State's argument as the instant appeal is both constitutionally and statutorily barred.
