{¶ 1} On May 4, 2006, appellee, Terrance Tate, was indicted for the murder of a child who had died from blunt-force injuries. Prior to the indictment, appellee gave a statement to officers of the Youngstown Police Department. Appellee later filed a motion to suppress that statement, and the motion was sustained by the Mahoning County Court of Common Pleas.
