{¶ 1} On May 19, 2008, defendant filed a motion for summary judgment pursuant to Civ.R. 56. On May 30, 2008, plaintiff filed a cross-motion for summary judgment and a memorandum contra to defendant's motion. On June 13, 2008, defendant filed a response to plaintiff's motion for summary judgment. On July 2, 2008, the motions came before the court for oral hearing.1
