Per Curiam.

{¶ 1} This is an appeal from a judgment dismissing a petition for a writ of quo warranto to oust a police chief and a writ of mandamus to compel a competitive promotional examination for police chief. Because the court of appeals erred in dismissing the petition, we reverse the judgment and remand the cause for further proceedings.
