{¶ 1} This matter is before the Court on the Notice of Appeal of Douglas R. Hagerty, filed September 25, 2007. On June 21, 2007, Hagerty was indicted on one count of grand theft of a motor vehicle, in violation of R.C. 2913.02(A)(1), and one count of possession of criminal tools, tools, in violation of R.C. 2923.24(A).
