{¶1} Appellant, Richard A. Miller, Sr., appeals the judgment of the Ashtabula County Court of Common Pleas, dismissing, with prejudice, his administrative appeal of a decision of the Ohio Department of Health. For the following reasons, we reverse the decision of the court below and remand for further proceedings consistent with this opinion.
