The order, insofar as appealed from, denied the cross-motion of nonparty MAK Assets, Inc., for leave to intervene in the action and, thereupon, for leave to serve and file an answer.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, and the cross-motion of nonparty...
