APPEAL, by permission of an Associate Judge of the Court of Appeals, from an order of the Appellate term of the Supreme Court in the First Judicial Department, entered November 22, 2022. The Appellate Term affirmed a judgment of the Criminal Court of the City of New York, New York County (Heidi C. Cesare, J.), which had convicted defendant, after a nonjury trial, of assault in the third degree.
