Appellant Jose Feliciano and a codefendant, Michael Roberts, were charged with murder in the second degree (Penal Law § 125.25[3]), three counts of robbery in the first degree (Penal Law § 160.15) and three counts of robbery in the second degree (Penal Law § 160.10). These charges stemmed from allegations that Feliciano and Roberts, acting in concert, robbed and fatally shot one victim in his apartment and in immediate flight therefrom, robbed another victim...
