MEMORANDUM.

Ordered that the judgments of conviction are reversed, as a matter of discretion in the interest of justice and on the law, and the matter is remitted to the Criminal Court for a new trial.

Insofar as is relevant to this appeal, defendant was charged in separate accusatory instruments with assault in the third degree (Penal Law § 120.00[1]) and harassment in the second degree (Penal Law § 240.26[1]), respectively...
