The order of the Appellate Division should be affirmed.

Defendant was charged with several crimes for beating the victim with a belt, including two counts of assault in the second degree. One count of assault in the second degree required the People to prove that with intent to cause physical injury to the victim, defendant caused such injury by means of a dangerous instrument...
