The defendant was arrested after he threw a gun to the ground while being pursued on foot by two police officers. After a hearing, the County Court denied that branch of the defendant's omnibus motion which was to suppress the physical evidence recovered, which included the gun, a magazine, and cartridges. After a jury trial, the defendant was convicted of criminal possession of a weapon in the second degree and resisting arrest...
