On February 23, 2006, the defendant George Grimes executed a note wherein he agreed to pay the principal amount of $464,000 to BNC Mortgage, Inc. The note was secured by a mortgage, also dated February 23, 2006, on real property owned by Grimes, located in Brooklyn.
