The defendant was convicted of, inter alia, driving while intoxicated, as a felony, in violation of Vehicle and Traffic Law § 1192 (3), based on an incident which occurred on June 16, 2013. We agree with the Supreme Court's denial of that branch of the defendant's omnibus motion which was to suppress evidence of his refusal to submit to a chemical breath test.
