Ordered that the order is modified, on the law, by deleting the provision thereof granting those branches of the defendants' motion which were for summary judgment dismissing the cause of action to recover damages for common-law negligence, so much of the cause of action to recover damages pursuant to General Municipal Law § 205-e as was predicated upon violations of Property Maintenance Code of New York State §§ 302.3
