MEMORANDUM.

Ordered that the judgments of conviction are affirmed.

Insofar as is relevant to this appeal, defendant was charged in separate accusatory instruments with aggravated driving while intoxicated (per se) (Vehicle and Traffic Law § 1192 [2-a] [a]) and common-law driving while intoxicated (Vehicle and Traffic Law § 1192 [3]).

At a jury trial, two witnesses testified that they had observed defendant driving...
