This proceeding arises out of a summons issued to petitioner, a New York City Transit bus driver, for allegedly failing, in violation of Vehicle and Traffic Law § 1146 (c), to "exercise due care to avoid colliding" with an 88-year-old pedestrian, causing the pedestrian's death.
