MEMORANDUM.

Ordered that so much of the appeal as is from the portion of the order entered October 13, 2015 that denied tenant's motion to dismiss the petition is dismissed; and it is further ordered that the final judgment is reversed, without costs, the order entered October 13, 2015 is vacated, landlord's motion for summary judgment is denied and tenant's motion to dismiss the petition...
