THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. ANDREW BARNETTE, Appellant.

Decided May 24, 2017.


Ordered that the judgment is modified, on the law and as a matter of discretion in the interest of justice, (1) by vacating the conviction of unlawful imprisonment in the second degree, vacating the sentence imposed thereon, and dismissing that count of the indictment, and (2) by providing that all of the sentences imposed shall run concurrently with each other; as so modified, the judgment is affirmed.
