In an action, inter alia, to recover damages for breach of contract and on an account stated, the plaintiff appeals from an order of the Supreme Court, Westchester County (Giacomo, J.), dated May 21, 2014, which granted the motion of the defendant Peekskill Housing Authority pursuant to CPLR 3211 (a) to dismiss the complaint insofar as asserted against it for failure to comply with Public Housing Law § 157 (1).
