Following a jury trial in 2006, defendant was convicted of murder in the second degree after shooting his downstairs neighbor (hereinafter the victim). On appeal, we vacated the conviction and ordered a new trial, finding that defendant did not receive the effective assistance of counsel (71 A.D.3d 1336
