Pursuant to a negotiated plea agreement, defendant pleaded guilty to assault in the first degree stemming from an incident in which the victim was beaten with an air rifle. No promises were made with respect to sentencing, although the People and defense counsel jointly recommended that defendant would be sentenced to eight years in prison followed by five years of postrelease supervision.
