Ordered that the order is affirmed, with costs.

On December 17, 2007, a vehicle operated by James Decaro collided with a vehicle operated by the plaintiff. Decaro died on April 4, 2009, of causes unrelated to the accident. On June 8, 2012, the plaintiff filed a summons and complaint naming "The Estate of James Decaro" as the defendant, seeking to recover damages for personal injuries resulting from the subject accident.
