In a proceeding pursuant to SCPA 1420 for the construction of a will, the petitioner appeals, as limited by her brief, from so much of an order of the Surrogate's Court, Nassau County (McCarty III, S.), dated July 24, 2012, as granted that branch of the respondents' motion which was to dismiss the petition pursuant to CPLR 3211 (a) (1).
Ordered that the order is affirmed insofar as appealed from, with costs payable by the petitioner personally.
