Petitioner commenced this CPLR article 78 proceeding challenging a February 2012 decision of respondent denying his request for parole release. Supreme Court dismissed the petition and this appeal ensued. The Attorney General has advised this Court that petitioner reappeared before respondent in August 2013, at which time his request for parole release was again denied.
