MEMORANDUM.

Ordered that the amended judgment of conviction is affirmed.

On April 3, 2009, defendant was convicted, upon his plea of guilty, of driving while intoxicated per se (Vehicle and Traffic Law § 1192 [2]) and was sentenced to three years' probation.
