Defendant is charged with resisting arrest (Penal Law § 205.30); obstructing governmental administration in the second degree (Penal Law § 195.05); and attempted assault in the third degree (Penal Law §§ 110.00, 120.00[1]). Defendant moves to dismiss all charges as facially insufficient. For the reasons stated below, defendant's motion is granted.<...
