Petitioner, a prison inmate, was charged in a misbehavior report with possessing a weapon and possessing an altered item after a toothbrush with one end sharpened to a point was discovered during a search of his cube. At the ensuing tier III disciplinary hearing, petitioner pleaded guilty to the altered item charge and was ultimately found guilty of the possession of a weapon charge.
