Defendant was charged with two counts of criminal possession of a weapon in the second degree in a joint indictment filed against him and his codefendant. In satisfaction of both counts, defendant pleaded guilty to the count charging him pursuant to Penal Law § 265.03 (3), with the understanding that he would be sentenced to a prison term no longer than four years.
