In this CPLR article 78 proceeding petitioner seeks to obtain records from the New York City Police Department (NYPD) pursuant to the State's Freedom of Information Law (Public Officers Law § 84 et seq., commonly referred to as FOIL). The records concern Richard Rosario, who has been incarcerated since 1996 after being convicted of murder.
