The order and judgment, inter alia, granted the motions of defendants Livingston Weston, Steven A. Abdoo and Peter M. Bolos for summary judgment dismissing the complaint against them.

It is hereby ordered that said cross appeal is unanimously dismissed and the order and judgment is modified on the law by denying the motion...
