THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. KENNETH McCRAY, Appellant.

Appellate Division of the Supreme Court of New York, Second Department.

Decided January 30, 2013.

Ordered that the judgment is modified, on the law and as a matter of discretion in the interest of justice, by vacating the provision of the sentence directing the defendant to pay restitution in the sum of $798 and substituting therefor a provision directing the defendant to pay restitution in the sum of $780; as so modified, the judgment is affirmed.
