JOYCE THOMAS, Respondent, v. NEW YORK CITY TRANSIT AUTHORITY, Appellant, et al., Defendants.

Appellate Division of the Supreme Court of New York, Second Department.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, and that branch of the motion of the defendant New York City Transit Authority which was for summary judgment dismissing the complaint insofar as asserted against it is granted.

The plaintiff allegedly slipped and fell on a wet, "slushy" step as she was exiting the front door of a bus operated by an employee of the defendant New York City Transit Authority (hereinafter the NYCTA)...
