Ordered that the judgment of conviction is affirmed.

The People charged defendant with, among other things, harassment in the second degree (Penal Law § 240.26 [1]). Prior to trial, defendant moved to dismiss the harassment charge, or, in the alternative, for sanctions, based on the People's failure to produce Brady material, namely a videotape taken by a surveillance...
