These four applications raise similar issues of law in an area where there is little precedent, various practices, and a controlling statute which the Practice Commentary to the New York Criminal Procedure Law characterizes as "poorly drafted and difficult to follow." (Peter Preiser, Practice Commentary, McKinney's Cons Laws of NY, Book 11A, CPL 420.40.)
