Nos. 7284, 6480/08.

941 N.Y.S.2d 491

2012 NY Slip Op 2573

THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. ANTHONY SMITH, Appellant.

Appellate Division of the Supreme Court of New York, First Department.

Decided April 5, 2012.

The court properly denied defendant's motion to withdraw his guilty plea. Defendant received a full opportunity to present his arguments, which were properly rejected by the court (see People v Frederick, 45 N.Y.2d 520 [1978]). Defendant, as well as new counsel appointed for the plea withdrawal motion, made written submissions. Neither defendant nor his counsel sought to amplify those submissions, and no hearing was requested.
