In this personal action arising out of injuries sustained by plaintiff Philip Wollruch ("Wollruch") during an on-line skating event, plaintiffs move for summary judgment on their claims against defendant Robert Jaekel ("Jaekel") on the grounds that Jaekel violated provisions of New York's Vehicle and Traffic Law ("VTL") and that this violation constitutes negligence per se.
